AC37 Event Limited is committed to protecting the privacy of all visitors to the website available at www.americascup.com, together with their corresponding online platforms, serving as the means through which services pertaining to the organization of the 37th America’s Cup (the “Website”). Before you proceed with use of the Website, please read the following privacy policy (the “Policy”) carefully to understand how we collect, use and disclose the information that you provide to us or authorise us to collect.

ACE Barcelona, S.L. will act as organiser within the European Union for AC37 Event Limited. 

In general, you can access and browse the Website without providing personal data. However, there may be times when we will request, or you will provide to us, or authorise us to collect personal data from you (such as your email address).

Additionally, the Website is used as a hub to provide information and collect personal data on behalf of other data controllers involved in the organisation of the 37th America’s Cup. In particular, the additional personal data controllers are:

When personal data will be collected in the name of any of the afore mentioned controllers, we would clearly identify the personal data controller and provide you with the information set out in Article 13 RGPD. 

Please be aware that this Policy only governs our use of personal data that is collected when using the Website. This Policy does not extend to the use of data submitted to us offline or submitted on any third-party websites to which links may be provided on the Website or any other America’s Cup team page. Who is the personal data controller of your personal data?

AC37 Event Limited, with offices at 56 Brigham Street, Auckland Central, Auckland, 1010 , New Zealand, is responsible for the processing of personal data collected through the Website unless otherwise stated in the particular section or form used to collect the personal data.

However, the main organizer of the 37th American’s Cup event that will take place in Spain is ACE Barcelona, S.L., with registered office at World Trade Center Barcelona, East Building, Barcelona’s Moll, s/n, floor 5º, 08039 – Barcelona.

What personal data do we process?

Through the Website there are some application forms, in which the following information is collected: 

  • Identification data: Name and last name 
  • Contact Information: Email and Mobile phone

Collection of your Personal Information if you are under 16 years

If you are under the age of 16 and you provide us with your email address:

  1. we may send you emails with information about products, services and events (refer below for further details); and
  2. you confirm that your parent or guardian has authorised you to establish your email account and to submit your email address to us for this purpose.

We will not use your email address for any other purpose, and we will not knowingly collect any other personal information about you.  However, due to the very limited scope of personal information that we collect, we are not able to independently verify your age or that you have complied with this section and, based on the family-friendly content of our communications, we do not take additional steps to do so.   • management of the mailing and subscription to the newsletter services offered throughout the Website, in accordance with the terms and conditions of the service;
  • for any other purpose authorised by you or permitted by law.

Please, be aware that the Website is a hub through which all the different entities involved in the organisation of the event provide information to anyone interested in the America’s Cup and remain accessible to visitors, therefore not all the forms used to collect personal data are administered on behalf of AC37 Event Limited or ACE Barcelona S.L. For this reason, we recommend you read the data protection information included in each of the forms before submitting your personal data.

With whom do we share Website users' personal data?

Organising an international event of the characteristics of the American’s Cup, often requires the collaboration of multidisciplinary teams located both in the main venue, and in additional venues, as well as the participation and supervision of the organising team, which for the 37th edition of the America’s Cup is Emirates Team New Zealand. 

For this reason, we may transfer personal data that we collect from you outside the country or region in which you are located and outside the European Economic Area (“EEA”). 

If we do this, we have procedures in place to ensure that your personal data receives the same protection as if it were being processed in the EEA. 

How long we will keep your personal data? 

Whenever we collect your personal data, we’ll only keep it for as long as is necessary for the purpose for which it was collected. At the end of that period, your personal data will either be deleted completely or anonymised, for example by aggregation with other data so that it can be used in a non-identifiable way for statistical analysis and business planning.
